How long does trademark registration in Malaysia take? +
Once a trademark application is filed with MyIPO, the examination process typically takes between 6 and 12 months before acceptance. Following acceptance, a two-month opposition period applies. The overall journey from filing to registration generally ranges from 12 to 24 months, depending on examiner queries and any opposition proceedings.
Can I file a patent in Malaysia if I've already disclosed the invention? +
Malaysia operates under an absolute novelty requirement, meaning prior public disclosure can jeopardise a patent application. There is a 12-month grace period for disclosures made at certain international exhibitions or by the inventor themselves. If you have disclosed your invention, please contact us promptly so we can assess the situation and determine the most appropriate course of action.
What is the difference between a utility patent and an innovation patent? +
Under Malaysian law, a utility patent (or "patent" under the Patents Act 1983) covers genuinely novel, non-obvious inventions and offers protection for up to 20 years. An innovation patent covers incremental improvements, has a lower inventive step threshold, and provides protection for up to 10 years. We assess which route is most appropriate based on the nature of your invention during our initial consultation.
